Workers' Compensation Law §11 bars suing your own employer (outside narrow exceptions like an employer's "grave injury" contribution claim context). But the bar stops at the employer's edge. Recurring third parties in the county where the accident occurred work-injury cases:
- The driver who hit you while you were working — an ordinary negligence case with no-fault overlay;
- The property owner where you were injured — premises liability for dangerous conditions at a site your employer didn't control;
- The manufacturer of the machine, forklift, or equipment that failed — strict products liability;
- On construction sites, the owner and general contractor under Labor Law §§240(1)/241(6) — the strongest third-party regime in the country.
The comp carrier holds a lien on the third-party recovery for benefits it paid — a lien that is negotiable, and negotiating it well changes the worker's net recovery meaningfully.
