New York wrongful death law is narrower and stricter than most families expect, and both of its defining features — a two-year deadline and a pecuniary-loss damage rule — shape every decision from the funeral onward. What follows is the honest map of how these cases work in the county where the accident occurred.

Two Years, an Estate, and Who May Sue

A wrongful death action (EPTL §5-4.1) must be brought within two years of the death — shorter than the three-year injury statute, and not extended by grief or estate delays. The suit is brought by the personal representative of the estate, not by family members individually, which means Surrogate's Court comes first: letters of administration must issue before the action can proceed. When the death involves a municipal defendant — a city vehicle, public hospital, housing authority — the GML §50-e notice of claim compresses the first deadline to 90 days.

Alongside the wrongful death claim, the estate brings the decedent's own claim for conscious pain and suffering between injury and death — a separate cause of action (EPTL §11-3.2) with its own proof and often substantial value.

The Pecuniary Loss Rule — and Building the Real Number

New York remains one of the few states whose wrongful death statute compensates only pecuniary loss (EPTL §5-4.3) — the economic value the decedent provided — and not the family's grief itself. It is a harsh rule, and building the case honestly within it means proving everything the decedent's life economically was and would have been:

  • Lost earnings and benefits over a full working life, built with economists;
  • The monetized value of household services, childcare, and — for children who lost a parent — loss of parental nurture and guidance, which New York treats as pecuniary;
  • Medical and funeral expenses, and the conscious pain-and-suffering claim, which is not limited by the pecuniary rule.

Because damages turn on documentation of a life, these cases are built from tax records, employment files, and family testimony — work that is easier begun early, however unwelcome that timing feels.

Frequently asked questions

Who receives the money in a New York wrongful death case?

The statutory distributees — generally the spouse and children, or parents of an unmarried decedent — in shares set by EPTL §5-4.4 according to their pecuniary loss, with Surrogate's Court approving the allocation. The recovery passes outside the will's general provisions.

We're still grieving and can't face a lawsuit yet. How much time do we truly have?

Two years from the date of death — and only 90 days if a government entity is involved, which describes more cases than people expect (city hospitals, public transit, municipal vehicles). Consulting a lawyer does not require you to be ready for litigation; it stops the deadlines from deciding the case for you.

The person responsible was criminally charged. Do we wait for that case to finish?

No — the civil claim proceeds independently and on its own clock (the two-year statute does not pause for a prosecution, though a related criminal case can extend it in limited circumstances). A conviction helps the civil case; an acquittal does not end it, because the civil burden of proof is lower.
